Episode details

James Czerniawski joins me to discuss two recent Supreme Court cases, Gonzalez v. Google and Twitter v. Tamana, which have implications for free speech on the internet and Section 230 of the Communications Decency Act. Section 230 is a law that protects websites from liability for third-party content.

Chenowski, a policy analyst, explains that repealing or reforming Section 230 could significantly impact speech online and limit access to new and diverse voices. The Gonzalez v. Google case involves a family suing Google over a terrorist attack in which an ISIS recruitment video was seen on the platform. The family argues that Google should be liable for recommending the video and aiding a terrorist organization. The case raises questions about liability for third-party content and the extent to which companies can be held responsible for the actions of their users.

James Czerniawski is a Senior Policy Analyst at Americans for Prosperity, a national think tank in DC with 35 state chapters nationwide. He writes about Section 230, antitrust, consumer data privacy, cybersecurity, and technology and innovation issues.
